The assessment will test the following learning outcomes:
Research appropriate legal resources and demonstrate an ability to apply legal principles to realistic factual scenarios containing employment law issues. In addition, be able to provide reasoned advice in answer to employment law problems.
Evaluate organisational policies and practices put in place to regulate the employment relationship in the light of legal obligations.
The case attached below is the bases of your coursework.
Case to Analyse:
Tasks: Write an analysis of the case. Your analysis must include the following sections:
1. Introduction. You must identify the key problems and issues in the case given. Formulate your objective and give a brief, concise and clear summary of the outcome of your analysis.
2. Contextualisation of the Case. Reflect the scenario of the case using your own words; set the relevant facts and the most important issues that you observe in the given case; demonstrate clearly the problems in the case under study.
3. Evaluation of the Case. Outline the focus of your analysis; assess this focus by discussing on what is right or not right; state why this focus is right or not right.
4. Proposed Solutions / Changes. Provide specific and realistic solution(s) or changes needed; Explain why these solutions were chosen. Support this solution with existing evidence, such as: provisions of the Oman Labour Laws; decided cases from the courts of the Gulf Countries; concepts from your readings; reliable literature or research studies and/or personal interviews.
5. Recommendations. Provide and discuss specific actions to accomplish the proposed solutions; mention what should be done and who should do it.
6. References. The strict observance and application of Harvard referencing style in the full text of the paper and in the reference list section must be followed. Any literature used to support the discussion must be up-to-date or its publication year must be from 2010 onwards.
