Question

The defendant was detained by D.E.A. agents and given his Miranda warnings. He waived his right to an attorney and confessed to drug charges. He claimed the Messiah would protect them. In United States v. Hemsi, 901 F.2d 293 (2d Cir. 1990), Sidney Hemsi was suffering from a mental illness that made him incompetent and committed him to the custody of the Attorney General to undergo treatment and evaluations. The court found that he wasn't able to understand the charges brought against him. Like Ziggy, he displayed behaviors that put his competency to question such as relying on a messiah. Therefore, based on Hemsi, his statements are inadmissible.
