Famous skateboarder, Anthony Buzzard, announced his retirement from the sport after winning the X games, and a career spanning over twenty years. He is the recognized "king" of the sport and the person who made it what it is today. At the press conference announcing his retirement, he was asked several times if he wouldn't reconsider his retirement but he was adamant that he had beaten every competitor in the sport, and he wanted to retire in order to devote his time to skateboard empire. Two months later, Buzzard was contacted by the new owner of the X Games and asked to participate in the Games one last time because next year's competition would be the tenth anniversary of the games. Buzzard relents and tells the owners, "OK, we're on!" Based on this representation, the owners pay Buzzard a $50,000 signing fee. Four months after receiving the signing fee, Buzzard contacts the owners and says that he really is going to retire, and will not participate in the Tenth Anniversary X Games.

Do the owners have to wait until the date of performance to sue Buzzard? Why or why not? Are they entitled to any damages? If yes, what type of damages and how much?
