Question

Techmart Co, is located in Mississauga Ontario, and is faced with a certification vote by the Communications, Energy and Paper Workers Union. (CEP).

The President of Techmart said to the Employees: "We would prefer that you vote not to unionize. Don't think that you can just "try out" a union. Once a union is certified, it is very difficult for employees to undo that decision. Check with the Labour Relations Board or check the law out for yourself and you'll find how difficult it is."

The Union, CEP, filed a complaint with the Labour Relations Board of Ontario alleging the President's comments were an unfair labour practice during the statutory freeze period. Explain whether you think the President's statement is an unfair labour practice or whether it is allowable and why. Explain your answer fully.
