Assignment The US Supreme Court decided a landmark employment law case. The name of this case is Wal-Mart v. Dukes. This case involves a class action lawsuit against Wal-Mart for employment discrimination. The plaintiffs alleged that Wal-Mart engaged in systemic gender discrimination and they were seeking to certify the class and sue on behalf of most women who work or worked for Wal-Mart. The Court ruled against the plaintiffs and refused to certify the class.
This case has major implications for every business in America and its effects will be felt for several years. The employers and employees both have arguments on whether this was a good decision for America. Your job is to write a 3 page paper analyzing the case and the arguments and pick a side and explain why your position is better than the opposing side.
If you type in any search engine, "Wal-Mart v. Dukes," you will get tons of hits discussing this case. So, you will have no trouble finding this case and commentary on this decision. It is only one of the biggest employment law cases in our history. I have also included a few sites that deal with US Supreme Court decisions. Your job is to do a little research on the case and the discussions on this case, and come up with your own arguments and write a paper discussing those arguments and support those points. I am looking for original thought in the arguments not a summary of the arguments out on the net! You think about this case and tell me what it means for you and your future business careers.
