One day, she advertised a tour package to Cameron Highland for RM 700 each including accommodation, meals and tickets according to her principal's order. On 1 August 2019, Neeta saw an ad on Facebook and was interested in booking the tour package from Chaleeda. She contacted Chaleeda through WhatApps and promised to meet her at Pizza Hut Pengkalan Chepa. After discussing about itinerary, Neeta agreed to take a tour package with her 5 other friends and paid for RM 4,000, including the collateral insured by Chaleeda herself. The difference was kept by Chaleeda. Unfortunately, Kayakkan Ada Sdn.Bhd discovered that Chaleeda received a secret profit from their client. Kayakkan Ada Sdn.Bhd asked for your advice, whether the company can sue Chaleeda or not. 2) According to Section 3(1) of Partnership Act 1961, partnership is the relation which subsists between people carrying on business in common with a view of prof the Nature of Partnership under Partnership Act 1961. 3. Rani, 16 years old girl was a Ceylonese Hindus. She entered into a marriage agreement with Rahul according to customary practice that provides for a dowry and a penalty for breach, and they went through a customary ceremony. Unfortunately, Rahul met another girl, Anjall and repudiated the promise of marriage and Rani then brought an action for breach of promise of marriage. The Defendant (Rahul) pleaded that the Plaintiff (Rani) had no capacity to enter into the marriage contract because she was a minor. Disappointed with Rahul, Rani went to further her study in University Malaysia Kelantan and make a student loan with Government of Malaysia. After 4 years studied in UMK Rani failed to pay for her loan. The government sued Rani as the first defendant together with her sureties for breach of contract. Rani then pleaded that at the time when the contract was made, she was a minor and the contract was void. She was not liable for the repayment of a reasonable sum spent on her. Advice Rani and Rahul with related law and relevance decided cases. Explain whether Rani can sue Rahul for the breach of marriage contract and whether she can be sued for breach of contract with Government of Malaysia or not together with the relevance law and cases. 4. On 1 September 2019, Najwa went for holiday at Perdana Hotel. After checked in, at 8 p.m, she went out for dinner with her soulmate, Amir. Najwa kept her jewelleries in her handbag and placed it in her suitcase under some clothes. After locking the suitcase, she gave the room key to the reception. When she lost the jewelleries after her suitcase was forced to open and her things ransacked, investigations showed that somebody had entered her hotel room while she was away. Explain whether Najwa was held to be negligent and whether the hotel had breached its duty of care to be liable for the guest's loss or not together with the relevance law and cases.
