Assignment:

During a business lunch, Mickey Mouse eats salad dressing that contains almond extract. Mickey is very allergic to nuts and suffers a severe allergic reaction. There are complications and Mickey becomes paralyzed from the neck down. Because Mickey had instructed Donald Duck, the restaurant waiter, and Minnie Mouse, the restaurant chef, that he might die if he ate any nuts, he sues the restaurant.

Can Donald Duck and/or Minnie Mouse be criminally prosecuted for what happened to Mickey? Yes, or no? When explaining your answer be sure to explain the required elements of a crime.
