A bifurcated trial in a capital case is where a jury is asked to make two decisions. The first decision is to determine guilt or innocence of the defendant. If the defendant is found not guilty, there will be no second part to the trial. If found guilty, the jury will then meet to decide punishment, which may include the death penalty.

  • Gregg v. Georgia, 428 U.S. 153 (1976)
