Assuming this set of facts, management has asked you as the Risk Manager, Project Consultant, Broker, or Claims Executive for the company to evaluate potential liabilities that could develop that could create unexpected/unplanned liabilities for the payment of workers' compensation benefits in regard to the following questions. The initial question is whether all 2,000 workers on the job could be considered employees of the company forpurposes of funding the claims pool with sufficient funds. Everyone agrees that these workers are not being paid by the company and in reality, the company would not supervise their activities. The workers were not hired by the company and in fact company personnel would not even know the workers. The company did not have the opportunity to interview of these workers prior to their employment and did not train these workers in ways that might preclude an accident on the job.
