Question: Independent Solutions is a consulting firm led by Ernie Flanders and is seeking to fill a market analyst position. The advertisement states that "candidates seeking the position must have an undergraduate degree in Marketing and a Master's degree in a business field is preferred". The ad directs interested persons to complete a online applicaiton that asks for name, address, date of birth, marital status, ages of children (if any) and has a checkbox to indicate gender. This form is the same form that has been used by the company for many years. The only update Independent Solutions has made to the application process is to require that applicants upload a photo of themselves - and submit with the application. After reviewing all of the applications, Ernie chooses two candidates to interview, Gary Jones and Jill Klein. Both have their bachelor's degree in Marketing and neither has a Master's degree. At both interviews, Ernie asks the interviewees about their intent to pursue a Master's degree in business, which he encourages. After Jill answers that she wants to pursue her Master's degree, Ernie laughs and says "How will you do that with 3 small children at home? Who are you Superwoman?" Ernie offers Gary the job citing that Gary "gave much more credible evidence" that he would seek his Master's degree since he had already applied and been accepted, while Jill had not yet applied.
