They orally agreed on a price of $3,500, with payment to be made within 4 days as well as the collection to be delivered within another 7 days. No written contract was executed. Two days later Hal sent Bruce a check for $3,500 that Bruce deposited. Bruce failed to transport the comic books and Hal now seeks to enforce the contract. This contract is
