Kirby, a mineral prospector, agreed with Lang to produce a survey of natural resources on land in Antarctica leased by Lang. At the time this contract was concluded it was known to Lang that the effects of climate change could make the survey somewhat more difficult to carry out than Kirby expected. Advise the parties in the following separate scenarios (the contract is governed by English law): Before the contract was concluded the law changed so that Lang will in fact be unable to exploit any natural resources on the land, but the parties only became aware of this once the survey was completed. Lang refused to pay for it. After the contract was concluded Kirby found that climate change had produced conditions which would make the survey twice as expensive than had been assumed. Kirby refused to carry it out.
