Gary Ewes went into a golf pro shop. He walked out with three golf clubs, priced at $399 each, concealed in his pants leg. An employee called police when she saw Ewes limping out of the shop. The police arrested Ewes. In the previous sixteen years, Ewes had been convicted of more than a dozen crimes ranging from petty theft to a string of burglaries and a robbery. He spent a total of approximately seven years in prison. Ewes was on parole, having been released from prison 10 months earlier, for the burglaries and the robbery at the time of the golf club episode.

Each stolen club yielded a conviction for felony grand theft. Had Ewes not had a prior record or had the prosecutor charged the case differently, the golf club charges could have been misdemeanors. As felonies, the golf club charges supported the imposition of the state's three-strike law. The Judge sentenced Ewes under that law to 25 years to life in prison. Does this sentence violate the Eighth Amendment? Why or why not?
