In the 1968 Terry v. Ohio decision by SCOTUS, in his lone dissenting opinion (8 to 1), Justice William Douglas believed the petitioner Terry was "seized" when he was stopped by Officer McFadden, "searched" when Officer McFadden "frisked" him, and since there was no "probable cause" to believe a crime had been committed, meaning Terry should not have been "searched," Terry should not have been arrested for carrying a concealed weapon.
