Disparate treatment involves intentional differential treatment based on a person's protected characteristic, such as race or gender. This type of discrimination is straightforward in its discriminatory nature. In contrast, disparate impact refers to practices or policies that, while appearing neutral on the surface, disproportionately disadvantage individuals in a protected class. Disparate impact is often unintentional and may occur inadvertently due to systemic biases or structural factors within an organization (Phillips, 2023). The Uniform Guidelines of Employee Selection Procedures offer essential recommendations to assist employers in avoiding unlawful disparate impact within their hiring and employment practices. If a selection method disproportionately affects a protected group, UGESP advises that the procedure must be validated to ensure it is job-related and adheres to business necessity.
