SCENARIO

A The Complaints Assessment Committees (CACs) dealt with three separate complaints about licensees who worked at different branches of the same real estate agency. As a result, one committee inquired into the conduct of an agent licensee and the agency itself regarding supervision and management of salespersons. Here is a summary of two of those complaints - Complaint 1 The complaint was against two licensees who held salespersons licenses. Grounds for complaint included - unconsented work was not disclosed, the sellers were not provided with appropriate price feedback, and the licensees did not follow client instructions not to lower the reserve. The supervisor of the licensees was a sales manager from another branch who held a salesperson real estate licence. Complaint 2 There were two findings of unsatisfactory conduct against the licensee under the Real Estate Agents Act. The licensee - gave incorrect advice to prospective purchasers about a cross lease title, and had not taken all reasonable steps to clarify the status of a defective drain notice. The supervisor of the licensee, the sales manager at the branch, held a salesperson class of licence.
