You will all be discussing the temporary eviction laws that passed in California to protect renters from being removed from their homes due to a lack of payment. Normally a person can be evicted after 30 days of non-payment of rent. Under Governor Newsom Signs Statewide COVID-19 Tenant and Landlord Protection Legislation, no tenant can be evicted before the extended ending date of the moritorium, as a result of rent owed due to a COVID-19 related hardship accrued between March 4 - August 31, 2020 (and beyond), if the tenant provides a declaration of hardship according to the legislation's timelines. The Governor has also extended the moratorium several times, but it has not been lifted (I believe or at last check).
This is also causing problems for some home buyers because of some apparent loop-hole some sellers have found in the laws. However, I would think and injunction and breach of contract might be able to be brought as well.
Go to the California Courts website and look up the COVID-19 eviction laws. You can find them easiest be going to Self-Help on Evictions and Housing and then clicking the link for new laws.
Complete the following: For this discussion, you are going to take the side of the tenant or the landlord and answer the following questions.
How would the temporary eviction laws help you?
Are/were these laws fair? Explain your answer.
