Norman is an illegal retailer, from Ivory Coast, living in Pinetown. He does not have a trading licence and buys goods from Sandra, a wholesaler. Norman misrepresents to Sandra on his credit application, that he is fully licenced. After six months, Norman owes Sandra R200 000 and refuses to pay, saying that the sales were all illegal and that he is therefore not bound to pay.

1. Advise Sandra of the different types of misrepresentation. Provide explanation and case law examples to justify your advice.

2. Discuss what damages can Sandra claim, if any?

Norman's case has been taken to the Pinetown court. He has been charged criminally and Sandra's attorney has instituted an action for the recovery of the outstanding debt.
