Katy and Peter had lived together for several months. Peter ended the relationship and moved to live with his sister, Lynn. Katy was devastated and began to write him a series of letters asking him to come back and also made a number of silent phone calls. Peter dismissed the phone calls as wrong numbers and threw the letters away. Increasingly frustrated, Katy wrote another letter in which she threatened to harm him and Lynn unless he agreed to meet her. Peter was worried about the letter and the following day he visited his GP who diagnosed him with mild depression.
Three days later, Katy travelled to Peter's house, arriving after dark. She saw a light on downstairs and peered through the window. Peter saw Katy and hid behind a chair. Lynn, who was eating her supper also looked up and saw Katy. She immediately realised who it was and rushed outside and threw the fork she had in her hand at Katy. The fork caught Katy on the face causing a gash to her cheek. Discuss the liability, if any, of Katy and Lynn for non-fatal offences against the person. Do not discuss self-defence.
