Sam works at Big Store and while he is helping a client, he sees another customer, Alice, take merchandise (shoes) and put it into a large purse. He follows Alice to the front door of the store and watches her leave the building. Sam follows her outside and says, “Miss may I speak to you for a minute?”. He approaches her, and she takes off running. He runs after her and stops her by taking her arm. She screams, “Take your hands off me.” He refuses, and says, “Miss you must come back in the store, and I must look inside your purse”. He takes her to an employee break room, where she is not visible to customers in the store. She repeats, “I didn’t steal anything. I didn’t steal anything.” Sam looks in her purse and finds the merchandise. He calls the police, and they arrive in approximately 45 minutes. The police officer takes her into custody by putting her in the back of his police car. While taking Alice to the station, he asks her why she stole the merchandise. She says that she needed some money. Discuss the civil and criminal legal actions that may arise out of this incident. Explain who wins and why.
