Stella was travelling between Athens and Adelaide. About an hour into the flight she heard a scream from behind her and she turned to see a man pointing his gun at another. Then a shot was fired and she saw a man fall into the aisle. An official looking man quickly detained the shooter, and the stewards took care of the man who it turned out had fallen in shock and was not injured. The flight pattern was altered so that the shooter could be taken off the plane. There was a touch-down in Singapore for this purpose. Stella consequently arrived in Adelaide six hours later than scheduled. Stella felt uneasy and anxious for the rest of the flight. As she went to step off the plane at Adelaide Airport she fell onto the tarmac. She sustained an injury to her ankle and her elbow.
Stella now suffers from depression and is also frightened to fly. She considers her state is due to the incident on the plane that she later found out involved a known criminal. She considers her fall was because the aircraft step was very high off the ground. Stella's modelling career has been put on hold, and she has missed out on a number of jobs while waiting for her conditions to heal.
Can Stella make a claim under the Convention? What can she claim?
In relation to Australian Consumer Law
Using the IRAC method
