In front of you is Samwell. Samwell is in court today because he was caught with 10 ounces of heroin. But this is not Samwell's first time in court. In the past, he got in trouble for selling bootleg DVDs. When asked by the judge last time why he was selling bootleg DVDs, he claimed it was because he had to pay off one of his drug debts. He explained that he has been suffering from a drug addiction problem since he was laid off from work and is trying to stay clean.

Given the above circumstances, how would you respond to Samwell's cases? Be sure to answer the following questions:

Would Samwell's recent case (i.e., drug possession) be held in a federal or state court? Explain your stance and justify why Samwell would be better suited in a federal or state court.
Given your earlier selection, explain why the case would not be held in the other type of court.
Now, consider the benefits of specialized courts. As you recall in class, there has been growing use of specialized or "problem-solving courts". In these specialized courts, we find unique court cases that cater to a certain type of offense and set of offenders. Do you think Samwell's case should be (or not) recommended to a drug court? Choose a side and explain why or why Samwell's case is (not) suited for a drug court.
