Sixteen-year-old Dane Pi was a cadet in his high school's ROTC program. As part of the program, he went to Ellsworth Air Force Base for a summer camp. To enter the base, he was required to sign a waiver that exempted the school from any and all liability for any injuries arising from his visit. While participating in the activities, on the base's confidence-building course, Pi fell from the top of the 10-foot climbing wall and suffered serious injuries. He filed a suit to recover his medical costs. The school asserted that he had signed their waiver of liability and therefore was prohibited from recovering any damages.
