Question: Differentiate between the Labour Relations Act and the Basic Conditions of Employment Act. And provide examples from the provided scenario.
The scenarios Sharon Merle Jackson has worked for a company called "Easy Access" for two (2) years. Although a qualified Chartered Accountant, her manager has demanded that she works in both the financial and marketing department. Her manager has also tasked her with doing the filing and administration of the business. Thus, her eight (8) hour working day, has turned into a twelve (12) hour working day. In total, Sharon works an average of sixty (60) hours a week. Sharon claims that her manager refuses to compensate her for the work that she does and continues to do, as well as the overtime that she works each day. Two weeks ago, Sharon ended up in hospital due to exhaustion. She has decided that she will only do the work that she gets paid for, and she will no longer work outside her field of expertise, unless she is compensated for it, and gets paid what she is owed. Also, Sharon requests that a contract is drafted and signed by the employer and herself, the employee, that states that she will be fairly compensated for the extra tasks that she is asked to perform. However, Sharon's manager views her "new-found" attitude as an act of defiance, thus she has decided to terminate Sharon's contract with "Easy Access".
