Generally speaking, there are four major ways of answering the question, "what is law?" They are: positivism, realism, natural law, and CLS (Critical Legal Studies) theory. The fancy word for these "ways" is "jurisprudence," which means "philosophy of law." Ewwww, not this crap again. Yep, but it will only hurt for a minute. which of the four you agree with most. Don't be giving me the "little bit of all of them" routine...it's too early to take the easy way out. The most important part of the post is explaining to us all "why" you are fond of the way you selected.

If the Supreme Court were to go back to the days of Hammer v. Dagenhart and rule that only goods and services involving interstate movement could be subject to federal law, what kinds of current federal programs might be lacking a sound basis for regulation under the commerce clause? Identify at least two and explain why the Hammer case would present a problem for these programs. Is there some other power or powers granted to Congress under the Constitution to legislate for the general good of society? What might those be? Why have most democracies failed historically, and what is James Madison's "cure," according to Diamond? Diamond discusses Richard Hofstadter's claim that the Founders were "anti-democrats" and that the Constitution is untrue to the principles of the Declaration of Independence. Do you agree with Diamond or Hofstadter...explain.
