Question
"Did Northern Shipping Company commit a tort? Negligence is the tort Northern is likely to have committed. If not for Northern's carless mooring, the ship wouldn't have broken loose, thus avoiding the subsequent damages. If so, explain what, and list the elements of said tort. Duty of care- Northern had a duty to ensure the ship was moored safely to prevent foreseeable harm. Breach of duty- By carelessly mooring the ship, Northern breached this duty. Causation- Northern's breach directly caused the chain of events that led to the damages. Damages- The fisherman's death, the damage to the bridge, and the flooding of the town all constitute damages as a result of the breach. Did Northern Shipping Company actually cause the damage to the sailors? The town? The bridge? Northern's negligence caused the fisherman's death since their ship broke loose and ran over his boat. The ship's obstruction of the river led to flooding, causing damage to the town. The loose ship also directly caused the bridge damage by lodging against it."
