Assignment:

Review and determine whether each of the following laws is procedural or substantive. Provide your reasoning and analysis in arriving at each decision.

  1. Every term of court shall commence and convene by operation of law at the time fixed by statute or local court rule without any act, order or formal opening by a judge, the judges or other officials, and shall continue to be open at all times until and including the day preceding the next regular term, on which day it shall expire by operation of law.
  2. For the purpose of purchasing any property or equipment necessary or incidental to the operation of an ambulance service, the board of directors may borrow money and issue bonds for the payment thereof in the manner provided herein.
  3. Any sheriff who shall fail or refuse to take up and impound a dog running at large shall be guilty of a misdemeanor and on conviction thereof fined not less than five dollars nor more than $25.
  4. Parties may obtain discovery by one or more of the following methods: depositions upon oral examination or written questions; written interrogatories; production of documents or things or permission to enter upon land or other property, for inspection and other purposes; physical and mental examinations; and requests for admission.
  5. Civil actions by minors may be commenced and prosecuted only by a duly appointed guardian of such minor or, if there is no such guardian, by a next friend appointed in such civil action; if asserted by counterclaim, cross-claim or third party pleadings, such civil action may only be prosecuted by a duly appointed guardian of such minor or, if there is no such guardian, by a guardian ad litem appointed for such civil action.
