Adam owned a restaurant with his friend George. After seven years in the restaurant business, Adam began to question his life and the path he had chosen. Adam became depressed and sought psychological counseling. After 6 months in counseling, Adam decided to leave the restaurant business and become a musician. When he told George about his decision and that he was leaving the business, George asked Adam how he wanted to end the business. Adam said he wanted one half of the cash in the restaurant bank account. George had his attorney draft an agreement conveying Adam's interest in the restaurant business to George for $35,000, which was one half of the money in the business bank account. Adam, ignoring the advice of his psychologist to hire his own attorney, signed the agreement. Adam later challenged the agreement on the grounds of incapacity. Will he succeed?
