Assignment:

As you continue your internship with SolWin, your supervising attorney, Mildred Ashdown, asks you to meet with a former employee. One of SolWin's employees, Jane Doe, was recently terminated after complaining about unpaid overtime and filing a complaint with the Department of Labor. She claims that her termination was a form of retaliation in violation of the Fair Labor Standards Act (FLSA) and other employment laws.

Instructions:

In a One to Two page memo that you will send to Attorney Ashdown, you have been asked to evaluate the situation and determine if Jane has a valid claim for wrongful termination and retaliation.

In this section, address the following questions:

Did the termination violate the Fair Labor Standards Act (FLSA)?

  • Explain the protections offered by the FLSA related to minimum wage, overtime pay, and anti-retaliation.
  • Analyze whether Jane's termination could be considered retaliatory, considering her complaint about unpaid overtime.

Could SolWin be liable for wrongful termination?

  • Define wrongful termination and explain the legal grounds on which Jane might claim her dismissal was unlawful.
  • Discuss relevant laws, such as Title VII, the FLSA, or California state laws, and how they apply to this situation.

What are SolWin's potential defenses?

  • Identify and explain potential defenses SolWin might raise in response to Jane's claim, such as documenting legitimate business reasons for her termination or demonstrating that her complaint did not play a role in the decision.

What are the possible remedies for Jane?

  • Discuss what remedies Jane might seek if the court finds that EcoWare retaliated against her or wrongfully terminated her. Consider remedies such as reinstatement, back pay, or damages for emotional distress.
