AMENDMENTS TO THE CRIMINAL CODE AFFECTING THE CRIMINAL LIABILITY OF ORGANIZATIONS.

Instructions: Review the legislation and the readings provided from the lecture notes. The background for Bill C-45 came from the fall out after the Westray mining disaster. Many of the families of the victims felt that the OHS legislation did not effectively penalize a company who had made so many mistakes.

In fact, they declared bankruptcy and insolvency right after the disaster so no fines or punishments were laid. The families asked for more to be done, so when negligence occurred, someone would have to be responsible and accountable. Now when a death takes place at a workplace, the person responsible can be held criminally liable, particularly if there was negligence in making decisions to protect health and safety. How does Bill C-45 change the way a person would manage a business?
