Mike had a couple of debit cards and also a few credit cards that allowed for cash withdraw. Mike had a busy week at school so he gave his debit card to his roommate on Monday to go buy groceries for the apartment. His roommate asked for the PIN, but Mike told him to just run it as a credit and sign his name because the store never checks IDs. His roommate went to the grocery store and bought groceries in the amount of $87.73 as he was instructed. However, instead of running it as a credit, he decided to try it as a debit card and use a series of numbers that spelled “MIKE” to see if that was the correct PIN. To the roommate’s amazement, it was the correct PIN for the debit card. The roommate then went to the ATM to check Mike’s balance. He found that Mike had $879.37 in the bank. He decided to take out the $50 that Mike owed him from the night before. When it came time for the roommate to return Mike’s debit card, he found he did not have it in his possession. He remembered that he did not get it from the ATM machine. Unwilling to admit his mistake to Mike, he told him it was probably just lost in the car and that he’d find it when he cleaned it out. In the meantime, someone that was behind the roommate in line at the ATM found the card and began using it. On Wednesday night, Mike ran out of cash and made plans to go to the bank the next morning to withdraw cash. On Thursday, Mike went to the bank and found that he had a negative balance in his account. He called his roommate and the roommate confessed his mistake. Mike then notified the bank that his card had been stolen Monday evening. Before notifying the banks, Mike's debit cards had been used to purchase gas, groceries, and clothing. In addition, cash withdraws were made at several ATMs as follows: Monday at 10:43pm- $100; Tuesday at 10:43 am-$225; and Wednesday at 9:55 pm- $175.
Is Mike liable for any cash withdraws from the ATM? If so, how much will he be held liable?
