Both parties are adults, the contract is oral and the painting is still in progress. Corelli pays Shelly the $2, 500 in return for her promise to delivered the painting to his home, when it is finished. A week or so later, after Shelly finishes the painting, a visitor to her gallery offers her $3,500 for it. Shelly sells the painting to the visitor and sends Corelli a signed letter explaining that she is canceling their contract for the moonrise painting. Corelli sues Shelly to enforce the contract.
