CASE STUDY

The City of Windsor passed an Interim Control By-law (ICB) on September 13, 2022. The ICB restricts the use of any land or buildings for dance clubs and bars, except for those already in operations, while the City conducts a study of all policies and regulations applying to such uses.

Your client, Pick Your Poison Inc., owns and operates a popular bar in downtown Windsor. The building abutting your client's building has gone up for sale. Your client would like to purchase the property and expand the bar into the adjacent building. (The sidewalls of the two buildings abut on the property line.) But PYP Inc. would have to act quickly, before the property is purchased by someone else.

If your client buys the property, is there any way it can overcome the ICB freeze, so that it can apply for a building permit to complete the expansion while the ICB remains in place (also considering the possibility that the ICB could be extended)? A legal memo to advise your client on the law, its options, including process and risk, and provide a recommendation on how it should proceed.
