John Shumate parked his car in a vacant lot where he had left it several times previously. When he returned, he was informed that the car had been towed at the property owner’s request. Thomas Younger had a collision with another car. His car was towed from the scene of the accident at the request of the police while Younger was discussing the accident with the police. The towing companies informed both car owners that they must pay towing and storage charges before their autos would be returned. The car owners sued to challenge the towing companies’ claim of a possessory lien. Can the towing company have a possessory lien? What kind of lien would it be? Could the owners be prevented from removing their cars until payment was made? Do the owners have different issues (i.e. should they receive different treatment)? Discuss fully.
