Discussion we are talking about caveat emptor, this is a common law doctrine that places the burden on buyers to reasonably examine property before making any purchase. In the case of Johnson v. Davis, 480 So.2d 625 (Fla. 1985) Johnson agreed to sell his house to Davis, but he failed to inform her of the poor structure of the roof. Davis asked Johnson about the water marks on the roof, but Johnson told her that they were not water marks, that the roof was in perfect condition. Everything else was in good condition and after Davis paid a deposit to Johnson, she came to find water gushing in the windows and the ceiling. That is when Davis brought a suit alleging a breach of the initial contract. I believe that in this case the concept of caveat emptor is there, because this is when the buyers fail to examine the property before buying it.
