The ostriches got the bird flu and have almost stopped laying eggs. Bird Brain Ranch can deliver only 10% of the quantity that they promised. The vet doesn't know how long it will take for the bird to recover. The Mad Batter's plumbing sprung a leak overnight. When the bakers got to the shop in the morning, water was streaming out from under the front door. They have to completely shut down for 4 weeks to make repairs. They have no alternative kitchen space to work in and no where to store perishable supplies like eggs. Because of the cost of repairs and replacing equipment, it is going to be at least 2 months before they can start paying their suppliers. Step 2 Using the information above, analyze 3 of your classmates' contracts. Identify the liquidated damages clause that would apply to each of the above scenarios and determine what the non-breaching party's remedy would be. Assess whether the liquidated damages clause is reasonable or if it would be considered an unenforceable penalty. If the liquidated damages clause does not help you determine the appropriate remedy, suggest a revision to add into the contract.
