Imagine you work for an automotive parts manufacturer called Neutron that exports to Malaysia's top automobile manufacturer, Proton.

You and your colleagues are approached by the COO of Proton, who also serves as Deputy Minister of Industry in Malaysia. The COO requests a 5% discount on all parts that your company supplies to Proton.

Even with the 5% discount your company would make a tidy profit, but you hear rumors from other Proton executives that the COO is cooking the books and you are concerned that if there is fraud involved then agreeing to the 5% discount may violate the US's Foreign Corrupt Practices Act and place your company in jeopardy.

After conferring with your company’s legal counsel you are informed that there is less than a .01% chance that the discount would be perceived as violating the FCPA.
