Question
You have recently signed a retainer agreement with Karla Rodriguez to apply for permanent residence through Express Entry. Ms. Rodriguez, a citizen of Peru, worked as a kindergarten teacher in Peru for five years prior to her arrival in Canada.
Karla came to BC in 2020 to study Early Childhood Education at Vancouver Community College. As part of her studies, she completed a paid internship at Coast-to-Coast Educare in Kelowna, BC. After she graduated from her program in April 2022, the company hired her on a part-time basis. She was then offered a full-time position in November 2022.
You are to provide your client advice regarding their eligibility for the Canadian Experience Class based upon your evaluation of their language test results and employer reference letter from Coast-to-Coast Educare.
The assignment includes two parts: your evaluation of their language results and employer reference letter about IRCC requirements and an email to your client advising them of their eligibility and any concerns you think need to be addressed.
PART 1 : Provide an evaluation of whether the language test results and employer reference letter will demonstrate the applicant meets the requirements of paragraphs 87.1(2)(a) to (d) of the Immigration and Refugee Protection Regulations, or IRPR.
In answering, you should consult and refer to the wording of the regulations, Immigration, Refugees and Citizenship Canada's operational instructions, the National Occupational Classification (NOC), and you are required to show your language test conversion to CLBs. The objective of the assignment is to demonstrate that you can navigate these resources and draw on them to make a reasoned analysis.
PART 2 Email Write an email to your client providing them with your preliminary evaluation of their eligibility for CEC. Explain any concerns you identified in evaluating their language test results and employer reference letter and suggest how these concerns should be addressed.
The assignment will be evaluated according to the following criteria:
Foundational Knowledge: Accuracy of references to the applicable law and policy documents.
Legal Reasoning: The coherence and persuasiveness of your reasoning.
Communication: The clarity, concision, and style (including spelling and grammar) of your answer as well as your ability to communicate effectively with your client.
