Social media influencer Kennedy Johnson has 2 million subscribers. She owns a corporation named Kennson Inc., which was formed under the state laws of Delaware, even though Kennedy primarily runs her corporation from North Carolina. Kennedy is currently president and CEO of Kennson Inc. She has about 10 employees in total. For the past two years, she has been running the business out of her garage, allowing about three-quarters of her employees to work from home, simply to produce and manage content. However, because she increased her product offerings, she required a bigger space to house her products as well as her in-house employees. Kennedy wants to focus on the big picture when it comes to running her business. She delegates the job of leasing commercial property to Micah, her operational manager. Micah enters into a lease at 123 Anyplace Way, a 3,000-square-foot commercial property with room for all of Kennson's business needs. Under the lease terms, Kennson has to pay $4,000 a month for the space and the lease is for one year. Kennson Inc. moves into 123 Anyplace Way. Unfortunately, Kennson's video views significantly dropped three months after moving. Kennedy eventually let go of half of her employees while she figured out how to deal with the drop in subscribers. She is contemplating breaking her lease to save a few months of rent.
? Is Kennson Inc. liable for its lease with the company that leases 123 Anyplace Way?
? If Kennson, Inc. defaults on its monthly lease, what rights and remedies does the owner of 123 Anyplace Way have against Kennson?
