Elegant Construction Pvt (Ltd.) is one of the leading construction company providing innovative construction solutions in the Sri Lankan construction industry. Elegant Construction Pvt (Ltd) new project is to construct sustainable houses in Colombo area.
Senior Management of Elegant Construction Pvt (Ltd.) is discussing on a strategic decision and they have decided to move from traditional construction methods to sustainable construction mechanism due to the energy demand in the country. Task 2
"Smart Engineering" is a leading construction firm in Sri Lanka and they have started their new project to build a five - star hotel at Kandy on 1 November 2021 to offer a high luxury accommodation feeling to those who are coming to visit Kandy. The client and the consultant of the project is "A & B Holdings" and "Expert Consultants" respectively. Since the project duration is one and half years and the progress of the project is very low than the planned, the client is unhappy with the status of the project.
Large number of variation works, reworking due to low quality of work, material supplying delays due to unavailability of selected materials. Further, client has not provided the advance payment as agreed and there were two weeks' delay for site possession, unsettlement of interim payments by the client, delay of forwarding interim payments by the consultant party, issuing delay drawings are the major issues between the parties.
Consider yourself as a ‘Negotiator' for the above dispute and discuss how you are going to prepare and conduct the negotiation process. Your discussion shall comprise of the following;
Identify issues as a client, consultant and contractor.
Identify the Negotiation skills
Explain the Negotiation Process to be used for above scenario.
