Question

David hired Supertransport Pte Ltd (Supertransport) to transport his goods from the port to his warehouse in Tuas. Supertransport quoted $3.00 per kilo for the goods to be transported, but once loading commenced Supertransport refused to continue loading unless David paid $5.50 per kilo, which Supertransport said was the seasonal market. It was the Chinese New Year season and David need to deliver the goods urgently to his customers. His customers threatened to sue unless the goods were delivered on the agreed date. It was also dif?cult to get other transporters at such short notice. David protested vehemently, but agreed to the new price since he did not have any choice.

Advise David whether he must pay the new price after the delivery is made.
