Think back to materials that you had in week 1, particularly the materials that dealt with the equal protection clause of the 14th Amendment (1868), the clause that courts use to strike down many forms of discrimination. Most state and federal laws create categories, most of which have some discriminatory impact. For example, states do not allow 13-year old youngsters to get a drivers license, but allow 18-year olds to drive legally. States require that individuals who want to do any number of things, from practicing law, to practicing medicine to running a day care center or being a plumber to meet specific educational requirements and pass tests. While these state actions are clearly discriminatory, courts have and continue to uphold them as not violating the 14th Amendment. However, if states tried to prohibit white children from attending classes in public schools with children of African descent, and vice versa courts would strike the proposed discrimination down as a violation of the equal protection clause. Explain why the courts uphold or sustain certain forms of discrimination but not other forms. Please give this your best shot. The concern is not just about 13-year olds driving, but has much broader implications.
