Tort law and Employment law:

Pat, a builder, is an employee of Tom's. One day on site the scaffolding that Pat is standing on collapses and he suffers personal injuries. The scaffolding was erected by Pat's fellow employee, Joe, who had not erected it properly. Pat initiates civil proceedings for damages for personal injury against Tom and Joe.

Please advise Pat under the law of tort.

Following the initiation of the civil proceedings against him Tom becomes unpleasant towards Pat. He laughs at Pat's hairstyle and makes derogatory remarks about the fact that he is gay. He gives Christmas bonuses to all his other employees but not to Pat. On the 1st January Tom announces that all employees will receive a pay-rise except for Pat. When Pat queries this Tom says "Queer boys don't get pay-rises". Then he begins to sing "Dancing Queen". Tom leaves work immediately.

Please advise Pat under Employment Law.
