Loans - Void Contracts

However all loans made for an infant are void and irrevocable.  Since in Leslie Ltd. v. Sheill the infant defendant had obtained two advances of two hundred pounds every from the plaintiffs after cheating them which he was an adult.  After the plaintiff sued him to recover £475 then the amount of the advances and accrued interest for as;

  1. First is Breach of contract, or alternatively, and
  2. Second is Fraudulent misrepresentation like i.e. deceit

Whatever it was held that so the infant was not liable since as;

  1. First is, could not be any breach for a void contract, and one is
  2. Second is, the Infants' Relief Act renders loans to infants "absolutely void" without several exception like cheating through an infant notwithstanding. Thus court was also of the view for making the infant liable in tort like i.e. deceit would have amounted to such an indirect enforcement for a contract rendered void with statute.
