Problem: The President of the United States accepted an invitation to give a commencement address at a small, Midwestern university in its auditorium. Pursuant to school rules, no one is permitted to bring posters, banners, or signs of any kind larger than the size of a piece of notebook paper into any event at the auditorium. The main purpose of the rule is to prevent obstruction of the view within the auditorium. Nevertheless, at the commencement ceremony, a student in a front row balcony seat unfurled a banner that he had hidden in his coat with a message supporting the President. The student was promptly arrested and charged in municipal court with trespassing. The student filed suit in federal court to enjoin the municipal prosecution and to have the trespass ordinance declared unconstitutional as applied to him.
