Problem: When the U.S. Supreme Court handed down a decision in Marbury v. Madison (1803) the Court forcefully carved out new ground for themselves whereby the justices are the final interpreters and last word on constitutional matters. This doctrine, now called judicial review, has been used by the Court to strike down more than a dozen significant federal laws and has influenced the high courts of numerous other countries as well. What do you think about judicial review? Should courts, most importantly the U.S. Supreme Court, have the sole power to declare laws and actions constitutional or do other government branches have a role in shaping and interpreting the constitution as well?
