Problem
Upon reading the scenario, the first thing that sticks out is the strong focus on monetary gain. When placing monetary gain as first importance, looking out for the client's best interest is no longer the top priority. Code 3.01 mentions a BCBAs responsibility to client's. Due to the overwhelming number of cases, the BCBA would struggle to prioritize the best interest of their clients because there would be so much work to get done, that not as much energy would be able to be focused on their clients. Due to the difficulty for the BCBAs to time manage and take on cases there should be some talk about Code 3.03: accepting new clients. In this case, the director should take a step back and listen to the BCBAs and slow down on accepting new clients until another BCBA can be hired on. In doing so, the BCBAs will then be able to use best practice for their clients. Another code to keep in mind is code 2.01: providing effective treatment. Given the circumstance with the BCBAs being overworked, the treatment being provided may not be effective due to having to do so many other things.
In this situation, I think it is important for the BCBA to have a conversation with the supervisor even though the BCBA feels their job could be on the line. As a BCBA, not following the ethics code could in itself produce some consequences. Therefore, I think it is better for the BCBA to have the conversation. If their job is in jeopardy then the company is most likely not aligning with the ethics code in the first place, so it will be better for the BCBA to practice in a company that does follow the ethics code.
