ASSIGNMENT - PROVINCIAL NOMINEE PROGRAMS
Purpose of Assignment: To Demonstrate an understanding of the Ontario Immigrant Nominee Programs.
The Task:
You are an RCIC (Regulated Canadian Immigration Consultant). In this capacity, you have been consulted and retained by Ms. Perini Scleroso to make recommendations and to complete all necessary forms. Perini is a native and citizen of the Principality of Liechtenstein. She wishes to obtain Permanent Resident status (and, ultimately, citizenship) in Canada for herself and for her husband, Waldorf Salat., who is a native of Luxembourg and is a citizen of both Luxembourg and Liechtenstein. They have no children.
Perini has done a lot of research and is of the view that the most expeditious and efficient way to achieve her goal of PR status is through an Ontario provincial nominee program. Perini has a sister, Edna Boyle, and other relatives in Paris, Ontario, and she and Waldorf would like to live and work near them. Coming from a small country, Perini specifically does not want to locate anywhere near Toronto.
Your task is to assess all of Perini's qualifications and credentials, to consider her personal goals and objectives, and to advise her as to which Ontario Immigrant Nominee Program (OINP) best suits her. Her English-language aptitude is at a benchmark of CLB 9 in speaking, CLB 9 in listening, at CLB 9 in reading, and CLB 7 in writing. Her French-language aptitude is at CLB 4 in all competencies. Both language tests were completed within the past four months. The goal is for the necessary application or expression of interest, as the case may be, to be submitted no later than August 31, 2019.
You are required to write a letter to Perini on your firm's letterhead which will consist of three parts, as described below. Each of Parts 2 and 3 must be clearly labelled and must start on a new page.
1. Part 1: Make a recommendation to Perini by identifying which one of the ten (10) OINP's best suits her. Explain your choice in detail. Do not address any other OINP's in this part. As of the date of this assignment, no details about the Tech stream and Smaller Communities pilot have been disclosed and they are not to be included in your analysis in this part or in Part 3.
2. Part 2: Describe what steps would be required by Perini and by you, as her RCIC, in order to file an application or submit an expression of interest, as the case may be, to the recommended OINP. Further, list and describe the documentation that must accompany her application or expression of interest (as the case may be).
3. Review the requirements of each of the other nine (9) OINP's and explain why each one is not the preferred OINP for Perini. This will require you to review every requirement of each OINP and discuss whether or not Perini satisfies each requirement. You must number the streams 1 through 9. As noted above as of the date of this assignment, no details about the Tech stream and Smaller Communities pilot have been disclosed and they are not to be included in your analysis in this part or in Part 1.
4. In addition, you will be marked on spelling; grammar; cover page, following instructions.
Perini has not created a profile through the federal Express Entry program, but she is willing to do so if it is required under the OINP. Therefore, not having an EE profile should not be a reason to rule out an OINP.
Perini was born on May 5, 1989, and Waldorf was born on August 2, 1989. They were married in a ceremony in Vaduz, Liechtenstein, on July 15, 2016.
Perini was awarded a Bachelor of Science degree in meteorology from the University of Liechtenstein in February 2012. This is equivalent to a similar degree from a Canadian university. Perini first came to Canada in May 2012 on a study permit. She obtained a Master of Science degree in mathematics from the University of Waterloo (Ontario) in August 2014, and a Ph.D. in nuclear physics from the University of Toronto in January 2019, having started that course of study in September 2014.
From September 2, 2014 until November 4, 2015, Perini worked as an apprentice nuclear physicist and as a meteorologist for Ontario Power Generation. This employment was part of her Ph.D. program of study, although she was paid a salary. She left that position in order to devote more time to her Ph.D. studies and writing her doctorate thesis. As much of her Ph.D. program involved independent study, Perini was able to pursue her doctorate work from Liechtenstein for much of the time, though she maintained her status in Canada as a student and came to Canada a number of times as required by her course of study.
During her time in Liechtenstein, Perini started a business in February 2016 that provides meteorology consulting. In the past year, the business has started manufacturing precision meteorology equipment. Perini's business in Liechtenstein is called Tobias Industries LLC. It has been immensely successful since it was founded, under her ownership and management, as well as, to a great extent, under the management of Waldorf. She has a number of contracts with various governments, including the governments of Japan, Israel, Liechtenstein and Luxembourg. Ideally, Perini would like to expand her business into Ontario by opening a branch. She estimates that she has a net worth of about CAD$780,000, and she is willing to invest at least $500,000 of this into her business in Canada (in addition to funds from other sources). Her net worth does not include Waldorf's assets.
As Waldorf has been involved in managing the business, Perini was able to maintain her temporary residence in Ontario for at least 15 of the past 24 months. At the present time, she is residing in Liechtenstein, having returned there upon her graduation from the University of Toronto. However, since May 1, 2019, she and Waldorf have been in Canada after entering as visitors in order to visit Perini's family in Paris as well as to explore possible business opportunities. She has an eTA (Electronic Travel Authorization).
If establishing her business in Canada is not feasible at this time, Perini will consider working as an employee if the right job offer is forthcoming. Based on her education and her specialized knowledge and skill, as well as informal discussions she has had with "head hunters," she does not feel she would have any problem finding an attractive position.
