For this assignment the nursing student decided to examine Minnesota Statute 148.264. In this statute the main topic for review is immunity. It was found that a nurse is protected from civil liability or criminal prosecution for submitting a good faith report. Essentially this statute protects the nurse from retribution for filing a good faith report. The nursing student believes this to be important because the nurse can file grievance against others or place of employment without having to fear for their personal welfare. By protecting the nurse from retribution, it allows for a more open channel of communication and more critical analysis of care. This will also lead to more open dialogue and an improved level of care through transparency.
This statute also protects member of the board, or those employed by the board, or on behalf of the board in participating in the investigation. They are also protected in their testimony regarding charges of violation and are also immune from civil liability and criminal prosecution. Furthermore, these individuals are protected and can honestly and accurately report without fear of their personal welfare. Again, the nursing student believes these protections to be vital in maintaining a transparent system where responsibility is on the shoulders of the organization, more so than on the shoulders of the individual.
