A local community west of Colorado Springs named Woodland Park which is a quaint little town in the mountains that is on a main route west further into the mountains. They had a situation a few years back. A business that focuses its restaurant on serving excellent types of chicken. There were several regulations about sign and their locations and content in effect. there, however, was a sidewalk that ran along the highway, and the businesses were behind the sidewalk in a shopping area off the highway. In order to advertise and bring attention to their business, they had someone in a chicken suit walk up and down that sidewalk with a sign that brought a lot of attention to their business in the form of paying customers. The city manager said that the person in the chicken suit walking up and down that sidewalk was not allowed even though there was no city ordinance prohibiting it. When challenged, he indicated that it was not allowed because he said it wasn't. Then, he drafted an ordinance and set it before the city commission. the city was sued to stop the ordinance. Is there any reason that the acts and city ordinance might be legal or illegal? What are those, either way, and what do you think the outcome was?
